The Company’s website and mobile applications can be accessed for certain exploratory features without registering or disclosing any personal information. To utilize the global investment services offered by the Company—specifically for opening a Demat account and establishing a cross-border trading channel for global stocks—it is necessary for a User to register on our platform.

Upon account creation, users receive unique login credentials (User ID and password). During onboarding, users must provide sensitive personal data and information required for regulatory compliance, including:

  • Email address and contact details
  • Communication and permanent address
  • PAN, Aadhaar, or other government-issued identity proofs
  • Bank account details (for funding international accounts)
  • FATCA (Foreign Account Tax Compliance Act) and CRS (Common Reporting Standard) disclosures mandatory for overseas investments
  • Financial information, income range, and net worth details (collectively referred to as “KYC Information”).

The Company may require additional personal information from time to time pursuant to regulatory amendments by SEBI, RBI, or overseas regulators (such as the US SEC or FINRA), or for the enhancement of services.

3. Purpose and Utilization of KYC Information

The KYC Information is utilized by the Company for communications, account maintenance, and executing cross-border investment mandates authorized by the User. To seamlessly enable global stock transactions, fractionally invest in international markets, and manage your global portfolio, this information will be used, shared, maintained, accessed, and stored with:

  • Partner clearing corporations and domestic depositories (CDSL/NSDL)
  • International brokerage partners and custodian banks
  • Third-party technology service providers
  • Authorized regulatory reporting entities

4. Verification and Document Submission

The Company may call upon the User to submit physical or digital evidence of their personal information (such as a PAN card, passport for overseas remittance verification, or utility bills for address proof) to comply with Liberalised Remittance Scheme (LRS) guidelines and Anti-Money Laundering (AML) standards.

We may also capture and verify bank details printed on uploaded documents (like a cancelled cheque or bank statement) to match registration data, ensuring secure fund transfers for international investing.

5. User Control and Data Access

Your Personal Information belongs entirely to you. Any update to your data requires logging into your secure account and providing valid supporting evidence.

In compliance with applicable laws, the Company will provide every registered User with a readable copy of the personal data we maintain. As an added security measure, we may require proof of identity prior to such disclosure.

Users are strictly advised to keep their login credentials confidential. If you suspect your account security has been compromised, you must contact the Company immediately.

Usage of KYC Information

The Company collects your information to fulfill the mandates issued by SEBI, the Reserve Bank of India (under FEMA/LRS guidelines for outbound remittances), and international financial authorities. The core objectives include:

  • Transaction Facilitation: To help users open Demat/trading accounts and seamlessly buy or sell global equities.
  • Communication: To send critical transaction alerts, legal notices, portfolio updates, and corporate action notifications.
  • Product Optimization: To tailor, customize, and enhance the Ultima Global platform based on user feedback and usage patterns.
  • Risk Management: To undertake market research, system problem resolution, and mitigation against fraud, identity theft, or unauthorized financial activities.

We may seek assistance from group companies, affiliates, third-party vendors, agents, or international financial partners (collectively, “Third-Party Service Providers”) to execute these services. All such partners are strictly bound by confidentiality and privacy restrictions identical to those outlined in this policy.

Sharing and Disclosure of KYC Information

The Company does not sell, rent, trade, or share your KYC Information with any unrelated third parties without your express consent, except:

  • Pursuant to statutory, legal, or regulatory requirements (domestic or international).
  • Pursuant to an order of a court of competent jurisdiction.
  • For seamlessly executing cross-border stock settlements, clearing, and asset custody.
  • To protect the vital financial interests and security of the Company, its users, and affiliates.

Upon a user requesting account deletion, personal KYC data will be deactivated and promptly removed from active databases, subject to statutory data retention timelines mandated by SEBI and financial regulators for auditing and compliance.

Notifications, Mailers, and Cookies

  • Communications: The Company may send periodic account summaries, global market research, newsletters, and promotional offers. Users can opt out of marketing communications at any time via the unsubscribe link, though operational and transaction-related alerts will continue to be delivered.
  • Cookies: Our platform uses alphanumeric cookies to ensure platform security, verify your active session, and optimize page load speeds based on browsing history. Disabling cookies via your browser settings may adversely affect platform functionality.

Data Security & Regulatory Compliance

Investdirect Capital Services Private Limited deploys enterprise-grade encryption, firewalls, and secure socket layers (SSL) to protect your data from unauthorized access, modification, or disclosure. When your data is shared with overseas clearing partners and international brokerages for transaction execution, it is treated as proprietary and confidential, accessed strictly on a need-to-know basis.

The Company operates under the jurisdiction of the (Indian) Information Technology Act, 2000, and complies fully with Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

This Privacy Policy is updated periodically. No modification will be made that curtails rights already accrued to a User without prior, explicit notification.
